These terms explain the rules for using the Brew Scan website, brewery directory, QR code services, accounts and membership plans.

Please read these terms carefully. By accessing Brew Scan, creating an account, submitting or claiming a brewery listing, purchasing a plan or using our services, you agree to these Terms and Conditions.

1. About Brew Scan

Brew Scan is a digital platform designed to help breweries create and manage public profiles, provide information to drinkers, use QR codes and understand scan activity.

Brew Scan is operated by Craftibeer Limited, trading as Brew Scan.

Our registered or principal business address is: 39 Blackfriars Avenue, Droitwich, Worcestershire, WR9 8RH, United Kingdom.

In these terms, “Brew Scan”, “we”, “us” and “our” refer to Craftibeer Limited, trading as Brew Scan. “You” and “your” refer to any visitor, registered user, brewery, business or authorised representative using our website or services.

2. Acceptance of these terms

These terms apply to your use of brewscan.com, associated Brew Scan pages, brewery profiles, accounts, QR codes, reports and related services.

You must not use our services if you do not agree to these terms. Additional terms may apply to a particular plan, promotion, trial, order or service. Where additional terms apply, we will make them available before you place an order or activate that service.

3. Eligibility and business use

You must be at least 18 years old to create or manage a brewery account, submit a brewery listing or purchase a Brew Scan plan.

Where you act for a brewery, company or other organisation, you confirm that you have authority to act for and bind that organisation.

Brew Scan’s paid brewery plans are intended primarily for business use. Nothing in these terms removes any legal rights that cannot lawfully be excluded.

4. Accounts and security

You must provide accurate, current and complete information when registering an account.

You are responsible for:

  • keeping your login details and password confidential;
  • restricting unauthorised access to your account;
  • checking that account and contact information remains accurate;
  • actions carried out through your account where you authorised them or failed to protect your login details; and
  • notifying us promptly if you believe your account has been compromised.

We may require identity, employment or ownership evidence before giving access to a brewery listing or account.

5. Brewery listings

Brewery profiles may be created by Brew Scan, submitted by a brewery, imported from publicly available sources or claimed by an authorised brewery representative.

Brewery listings may include information such as the brewery’s name, address, contact information, description, website, shop, social media, facilities, photographs, products and other relevant details.

A brewery or authorised representative must ensure that information it submits is accurate, lawful, current and not misleading.

We may edit formatting, correct obvious spelling errors, resize images or make minor presentation changes without changing the intended meaning of submitted content.

We do not guarantee that every brewery submitted to Brew Scan will be accepted or published.

6. User content and images

You retain ownership of content that you submit, including brewery descriptions, logos, photographs, product information and promotional material.

By submitting content, you give Brew Scan a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, format, display and distribute that content as reasonably required to provide and promote the Brew Scan service.

You confirm that:

  • you own the submitted content or have permission to use it;
  • its use by Brew Scan will not infringe another person’s rights;
  • it is accurate and not misleading;
  • it does not contain unlawful, defamatory or harmful material;
  • you have obtained appropriate permission from identifiable people shown in photographs; and
  • it does not contain confidential information that should not be published.

You may ask us to remove content that you own, although copies may remain temporarily in backups or where retention is legally required.

7. Claiming a brewery profile

Brew Scan may allow an authorised representative to claim an existing brewery profile.

We may request evidence such as access to an official business email address, website verification, company information or other reasonable proof of authority.

We may refuse, delay or reverse a claim where ownership or authority is disputed, unclear or potentially fraudulent.

Claiming a listing does not transfer ownership of the Brew Scan website, page layout, platform, software or directory structure.

8. QR codes and analytics

Brew Scan may provide static or dynamic QR codes, short links, landing pages, scan tracking, reports and related services.

A brewery is responsible for checking and approving a QR code and its destination before printing it on labels, cans, bottles, pump clips, packaging, signs or promotional material.

We strongly recommend testing each QR code on several devices before committing to large print quantities.

Unless we expressly agree otherwise in writing, Brew Scan is not responsible for printing costs, packaging costs, label replacement or other losses caused by a brewery printing an incorrect, untested, expired or outdated QR code or destination.

Dynamic QR destinations may depend on an active Brew Scan service or subscription. We will explain any applicable restrictions before the service is purchased.

9. Analytics, location data and reporting accuracy

QR scan reports and analytics are intended to provide useful business insights. They should not be treated as guaranteed measurements of individual customers, product sales or unique drinkers.

Scan figures may be affected by repeat scans, automated systems, privacy controls, network routing, device settings, browser settings, blocked scripts and other technical factors.

Geographic information may be approximate and may identify the location of an internet connection or network provider rather than the precise position of the person scanning.

We do not guarantee that reports will be completely error-free or that every scan will be recorded.

10. Free and paid plans

Brew Scan may provide free, trial and paid plans. The features, limits, number of listings, QR codes, reports, storage and support included in each plan will be shown on the relevant product or pricing page.

A free plan does not guarantee permanent access to every free feature. We may amend free-plan limits or withdraw a free service after giving reasonable notice where practicable.

Paid features are available only while the relevant order or subscription remains active and payments are up to date.

11. Prices, payments and automatic renewal

Prices are displayed in the currency shown at checkout. Unless clearly stated otherwise, prices exclude VAT and any other applicable taxes.

You must provide valid payment information and authorise us and our payment providers to collect the amount shown at checkout.

Where you purchase a recurring subscription, it will renew at the frequency shown at checkout until cancelled. The renewal price and billing period will be displayed before the order is placed.

We may change subscription prices. Where a price change affects an existing subscription, we will provide reasonable advance notice and explain when the new price will apply.

If payment fails, we may retry collection, restrict paid features or suspend the relevant service until the outstanding amount is paid.

12. Cancellation and refunds

You can cancel a recurring subscription through your account where that option is available, or by contacting us.

Cancellation normally prevents the next renewal. Unless required by law or stated otherwise in the applicable plan terms, access to paid features will continue until the end of the period already paid for.

Payments already made are not automatically refundable merely because a business no longer requires the service. We may, however, provide a refund or account credit where appropriate, including where required by law or where a service has not been provided as agreed.

Cancelling a subscription does not necessarily remove a public brewery listing. The listing may remain as a free or unclaimed directory profile, unless removal is requested and we agree that removal is appropriate.

Nothing in these terms affects any statutory cancellation, refund or consumer rights that apply to you.

13. Acceptable use

You must not:

  • use Brew Scan for unlawful, fraudulent or deceptive purposes;
  • impersonate another person, brewery or organisation;
  • submit false claims of brewery ownership or authority;
  • upload malicious code, viruses or harmful files;
  • attempt to gain unauthorised access to accounts, systems or data;
  • scrape, copy or extract substantial parts of the directory using automated tools without permission;
  • interfere with the operation, security or performance of the platform;
  • publish content that infringes intellectual property, privacy or other legal rights;
  • use the service to send unsolicited or unlawful marketing;
  • manipulate scans or analytics to create misleading results; or
  • use Brew Scan in a manner that could damage our reputation or the reputation of another brewery.

14. Review, moderation and removal

New listings and changes to existing listings may require approval before publication.

We may reject, edit, hide, suspend or remove content or listings where we reasonably believe they are inaccurate, unlawful, misleading, abusive, duplicated, outdated or contrary to these terms.

We are not required to monitor every listing continuously. Users should report suspected errors or inappropriate content to us.

15. Third-party websites and services

Brewery profiles may contain links to brewery websites, shops, ticketing services, maps, social media platforms and other third-party services.

Brew Scan does not control those external services and is not responsible for their content, availability, security, products, pricing, delivery, privacy practices or terms.

A link does not necessarily mean that Brew Scan endorses the third party. Transactions made through an external website are between you and that third party.

Some Brew Scan functions may also depend on third-party hosting, analytics, QR, payment, email, mapping or software providers.

16. Brew Scan intellectual property

The Brew Scan name, logos, branding, website design, page layouts, graphics, software, database structure, reports, templates and original content are owned by or licensed to Craftibeer Limited.

You may use Brew Scan materials only as necessary to receive and use the service in accordance with these terms.

You must not copy, sell, licence, reproduce, modify or commercially exploit Brew Scan materials without our written permission, except where the law expressly allows it.

Brewery names, logos and product images remain the property of their respective owners.

17. Website and service availability

We aim to keep Brew Scan secure and available, but we do not guarantee uninterrupted or error-free access.

Access may be interrupted for maintenance, updates, security work, hosting problems, internet failures or events outside our reasonable control.

We may change, improve, replace or discontinue parts of the service. Where a material change affects a paid service, we will provide reasonable notice where practicable.

18. Our liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Nothing in these terms limits any statutory rights that cannot lawfully be excluded.

Business users

Where you use Brew Scan for business purposes, we will not be liable for indirect or consequential loss, loss of profit, loss of revenue, loss of anticipated savings, loss of goodwill, loss of opportunity or loss of business data, except where such liability cannot lawfully be excluded.

Subject to the exclusions above and unless a separate written agreement states otherwise, our total liability relating to a paid service will not exceed the amount you paid to Brew Scan for that service during the 12 months immediately preceding the event giving rise to the claim.

This limit does not apply to liability that cannot lawfully be limited.

Website visitors

Directory information is provided for general information. Visitors should verify important details directly with the relevant brewery before travelling, making a purchase or relying on information such as opening hours, accessibility, allergens, events or product availability.

19. Responsibility for business-submitted material

A business user is responsible for claims arising directly from content it submits, its breach of these terms, its misuse of the service or its infringement of another person’s rights.

Where legally permitted, the business user will reimburse Brew Scan for reasonable losses, liabilities and costs resulting from such a claim, provided that we give reasonable notice and do not settle the claim unreasonably without consulting the business.

20. Suspension and termination

You may stop using Brew Scan at any time. Subscription cancellation is dealt with in section 12.

We may suspend or terminate access where:

  • you materially or repeatedly breach these terms;
  • payment remains overdue;
  • we reasonably suspect fraud, misuse or a security risk;
  • you submit unlawful or infringing material;
  • continued access could harm Brew Scan, its users or another party; or
  • we are required to do so by law or a competent authority.

Where appropriate, we will give you an opportunity to correct a problem before terminating access. Immediate action may be taken where there is fraud, illegality, serious risk or a significant security concern.

Provisions intended to continue after termination, including ownership, payment obligations, liability and governing law, will remain in effect.

21. Privacy and cookies

Our handling of personal information is explained separately in our Privacy Policy.

Please read our Privacy Policy and our Cookie Policy, where available.

You must not upload personal information to Brew Scan unless you have a lawful reason and appropriate authority to do so.

22. Changes to these terms

We may update these terms to reflect changes to our services, pricing, technology, business operations or legal obligations.

The latest version will be published on this page with an updated date. Where a change materially affects an existing paid service, we will provide reasonable advance notice where practicable.

Changes will not retrospectively remove rights that have already arisen.

23. General provisions

Entire agreement

These terms, the applicable order details, plan description and any additional terms expressly agreed in writing form the agreement between you and Brew Scan for the relevant service.

Severability

If a court or competent authority decides that part of these terms is unlawful or unenforceable, the remaining provisions will continue to apply.

No waiver

A delay in enforcing a right does not mean that the right has been waived.

Transfer

We may transfer our rights and obligations as part of a legitimate business sale, restructuring or transfer, provided that this does not reduce your legal rights. You may not transfer a paid account or agreement without our written permission.

Third-party rights

Unless these terms expressly state otherwise, a person who is not a party to the agreement has no right to enforce it.

24. Governing law and disputes

These terms are governed by the laws of England and Wales.

Where you use Brew Scan as a business, the courts of England and Wales will have exclusive jurisdiction over disputes arising from these terms or the service.

Where you are legally treated as a consumer, you may also have the right to bring proceedings in the part of the United Kingdom in which you live, and your mandatory consumer rights remain unaffected.

Before starting formal proceedings, both parties should try to resolve the matter by contacting the other party and providing reasonable details of the issue.
